Water Safety Waiver & Release of Liability

Acknowledgement

I acknowledge that I am voluntarily participating in a guided kayak tour, and that this involves inherent risks associated with being on open water.

I understand that participation involves risks including but not limited to:

• capsizing, immersion in water, and cold water exposure;

• changing weather, tidal and current conditions;

• collision with other watercraft, wildlife or submerged objects;

• physical exertion; and

• other hazards associated with open-water activities.

I acknowledge and agree that:

I participate entirely at my own risk.

I will wear a personal flotation device at all times while on the water, as instructed by guides.

I will immediately follow all directions given by tour guides.

I am a competent swimmer and am physically capable of participating, or have disclosed otherwise before booking.

I accept responsibility for supervising any children accompanying me.

Release

To the fullest extent permitted by law, I release and discharge the tour operator, its owners, guides and representatives from liability for personal injury, loss or damage arising from my participation, except where liability cannot legally be excluded.

I acknowledge that nothing in this document excludes rights or guarantees that cannot be excluded under consumer law.
